Please read these Terms of Use carefully before visiting, registering with, purchasing from, or using BytesPulse services.
Introduction
BytesPulse – Bytespulse.com, a General Partnership with VAT number 802567794, GEMI number 178741622000 and registered seat in Chalkida, Evia, is a website offering products and services via the Internet. By visiting our website, registering with it, purchasing and/or using our services, you accept the following terms and conditions.
If any user, customer or visitor disagrees with any part or all of the following terms and conditions, please do not use our website and/or our services.
Terminology
Whenever the words “BytesPulse”, “Bytespulse.com”, “Company”, “We”, “Us” or “Website” appear in this document, they refer to BytesPulse G.P. The words “User”, “Customer”, “Visitor”, “You” and “Your” refer to you, the user of the Bytespulse.com website.
Company Responsibility – Customer Responsibility
BytesPulse informs the customer by email regarding the necessary control panel access details (username, password), technical support matters, informational content, and billing and/or payment reminders. The above communication may also be provided by other means such as telephone communication, tickets or live chat.
In such cases, the customer acknowledges that BytesPulse bears no responsibility for the completeness or validity of the above information and support services, nor for possible malfunctions of the Company’s information systems.
BytesPulse takes daily, weekly and monthly backups of customers’ files, databases and emails. The monthly backup is created in the early hours of the 1st calendar day of each month, while the weekly backup is created in the early hours of every Sunday. Each backup is retained for the corresponding period (1 day, 1 week, 1 month). In the event of hardware or software failure, BytesPulse bears no responsibility if the backups cannot be used or are not up to date. The Customer is responsible for keeping backup copies of their files, databases and emails on their own personal computer.
BytesPulse upgrades its infrastructure, both hardware and software, at regular intervals in order to ensure the smooth operation and security of its infrastructure, services and customers. The Customer is responsible for updating their content so that it remains compatible with the Company’s services. BytesPulse bears no responsibility for any malfunction of the Customer’s website following an upgrade, nor for any loss, damage and/or non-material harm suffered.
BytesPulse is under no obligation to inspect and/or configure the information (files) transferred to and stored on its servers by its Customers. The Customer must upload ready-to-use material and know how to use it.
BytesPulse has the right to access the Customer’s files and data for the purposes of technical support, checks and works required for the optimal performance of the servers, as well as upon request by prosecutorial, police or judicial authorities.
The Customer is prohibited from using BytesPulse services for any unlawful purpose, such as publishing pornographic content, pirated content, files originating from theft, republishing content without the necessary permission of the publisher, and infringing intellectual property rights. Abusive content, content offending public decency, and content unsuitable for persons under 18 years of age are also expressly prohibited.
BytesPulse is not responsible for the content of its Customers’ accounts and does not guarantee the accuracy of the information provided through them.
BytesPulse reserves the right to temporarily suspend the Customer’s account or remove any material (texts, photographs, videos and, generally, any kind of files) it considers inappropriate or capable of harming the Company or third parties, without prior notice and without compensation to any person whatsoever.
BytesPulse cannot be held responsible for problems affecting its infrastructure, hardware failures, causes arising from natural disasters (floods, fires, earthquakes, etc.) or conditions beyond its reasonable control such as marches, demonstrations, vandalism, public holidays or strikes. BytesPulse will make its best efforts to resolve the issue and provide prompt support.
Services
Domain Names
The person or entity registering a domain name is its lawful owner. If the Customer decides not to renew a domain, BytesPulse bears no responsibility for any problems or issues that may arise after the expiration of the registration term. The owner of a domain is responsible for monitoring its expiry date and renewing it, if desired, up to the day before the stated expiry date through the client area.
Domains become the property of the Customer who registers them upon completion of the purchase. Therefore, domain registration cannot be revoked and compensation is not possible.
Web Hosting
The Customer agrees to make reasonable use of the server resources of the hosting service and acknowledges that all resources are not intended for their exclusive use and that the server resources are shared with other Customers.
Use of more than 10% of the server resources is not permitted and may lead to termination of the Customer’s account without prior notice.
Hosting packages do not allow hosting of video files or video streaming. Torrent and mining software are also not permitted.
Emails
The Customer agrees to make reasonable use of their email service and that the average email traffic sent through the server remains within the limits of normal activity for an average Internet user, which is defined as sending 100 emails per hour per domain name.
It is expressly prohibited, and constitutes grounds for immediate termination of the customer account, to send messages, whether in bulk or otherwise, to recipients who have not requested to receive them (spamming), to subscribe a recipient to a mailing list without their approval, and to advertise services and/or products of sites hosted on a BytesPulse server through spamming in any direct or indirect way, even if such messages were sent outside BytesPulse servers.
Web Design – Web Development
For the development of a website or other software, the Customer signs a separate agreement containing the applicable terms of use.
Pre-installed Applications – Scripts
BytesPulse offers, in some hosting packages, the option of automatic installation of certain Open Source software applications. The Customer may install and use such software at their own responsibility. BytesPulse bears no responsibility and provides no warranty for the proper installation or operation of the above applications.
Transactions – Payments
The Customer may purchase and pay for orders via credit or debit card (Viva Wallet, Stripe), PayPal, and bank deposit (Eurobank). In the case of a bank deposit, BytesPulse will rely on the payment reference/description and not on the name of the depositor for the correct processing of the order.
BytesPulse recognises the importance of the security of Personal Data and Electronic Transactions and has taken all necessary measures, using the most modern and advanced methods, to ensure the highest possible level of customer security. All information related to your personal data is secure and confidential. Card details are not stored under any circumstances.
BytesPulse has the right to suspend, discontinue or delete all accounts, domains and even backups if the customer has an outstanding balance for one or more services in their account.
Indemnities
BytesPulse undertakes not to disclose or sell the Customer’s personal data to any third party. BytesPulse will disclose such data to the authorities only in the event of a violation of the law.
The Customer agrees to defend BytesPulse before any court, indemnify it, hold it harmless from any danger, and protect it against all claims, losses, monetary demands and liabilities, and to cover any financial costs including lawyers’ fees, arising from any case or claim due to damage, injury or any other cause brought by any third party against BytesPulse as a result of the customer’s activities, services, other acts, or content and information transmitted through the customer’s hosting account.
In any distance contract, where the customer is a natural person (and no invoice has been issued), the customer has the right to withdraw without giving any reason within fourteen (14) calendar days. The purchase of Hosting is accompanied by a 14-day money-back guarantee from the date of commencement of the service. If the Customer is not satisfied with BytesPulse services, they may, within 14 days from the date of purchase of the respective service, request cancellation of this agreement. In such a case, the total subscription amount is refunded to the Customer. If the subscription amount includes additional charges such as domain name purchase, bank or third-party fees, or additional services, the refund to the Customer will be made after deduction of those amounts.
Changes to the Terms of Use
BytesPulse reserves the right to modify, at its discretion and without any other notice apart from an announcement in this area, the Terms of Use of its services and website.
The Customer is responsible for reviewing changes to the Terms of Use on a regular basis from this page.
Important notice regarding language: The official and legally binding Terms of Use of BytesPulse are provided in Greek. This English text is an unofficial translation published for convenience and general information only. It is intended to help non-Greek-speaking visitors understand the main content of the Terms of Use, but it does not create independent legal effect. In the event of any discrepancy, inconsistency, ambiguity or interpretative issue between the Greek version and this English translation, the Greek version shall prevail and govern.
